Private Investor Tests (PIT)

  • Preparation of the baseline assumptions for the PIT test
  • Planning of future business operations
  • Market economy operator test
  • Final preparation of the private (market) investor test

A PIT test is a procedure used to assess whether a planned state aid measure constitutes unlawful state aid. We support companies and public entities in analyzing transaction conditions and assessing whether such a transaction could be carried out under the same terms by a private investor or a market economy operator. By doing so, we help ensure compliance with applicable state aid rules and reduce regulatory risks already at the planning stage.
